EEO and Anti-Bullying Training for Senior Managers Custodians of Culture
Target Audience:
Current or potential investigators who investigate staff grievances in particular those related to allegations of workplace discrimination, harassment or bullying. Participants should have a general understanding of the need for an organisation to be compliant with federal and state legislation, a desire to see natural justice in cases of contraventions to key policies and an interest in employment law matters.
Key Objective:
To ensure that participants understand the key principles behind conducting a workplace investigation related unlawful discrimination, harassment or bullying. Furthermore that they can execute a sound and legitimate process once a complaint has been brought to them.
Learning Outcomes:

At the conclusion of this program participants will be able to:

  • Articulate the key principles of running workplace investigations-in particular those related to natural justice.
  • Articulate the rights of different parties involved in an investigation.
  • Develop a strategy for conducting a legitimate investigation in the workplace.
  • Conduct an complaints handling meeting with a plaintiff and respondent.
  • Pull together statements including those from a plaintiff and respondent as well as relevant witnesses.
  • Conduct investigative interviews using a methodology appropriate to modern workplace values and natural justice.
  • Execute a legitimate process of decision making based on the balance of probabilities.
  • Make legitimate decisions on actions that may be exercised once allegations are found to have substance.
  • Make decisions in regards to information released to those directly involved in a matter.
  • Make decisions in relation to the use of external resources to conduct an investigation.

Senior Workplace Relations Practitioner/Expert Investigator, Course Facilitator and Workplace Reality Theatre.

Structure:

Full day, up to 15 participants per session.
